General Terms and Conditions

Terms and Conditions

Please read the following Terms and Conditions carefully before using the products and services provided by Brighten Up. In the following, Brighten Up may also be referred to as the “Seller” and the party to whom the seller’s quote and or invoice(s) are addressed to, may also be referred to as the “Consumer.” This Agreement sets forth legally binding terms and conditions for your purchase and installation of window coverings as well as any other services provided by Brighten Up.


Products and Services
1.1 Product Description: Brighten Up offers a wide range of window coverings for sale, including but not limited to blinds, shades, and shutters.
1.2 Installation Services: Brighten Up provides installation services for the window coverings purchased from their company.
1.3 Other Services: Brighten Up provides other services for customers including but not limited to furniture assembly, hanging stuff on walls, and other simple handyman jobs. 


Ordering and Payments
2.1 Ordering: Items ordered are clearly stated on the invoice(s). Orders can be confirmed in the consumer's home during an in-home consultation, by phone, text, and or email. 
2.2 Pricing: The prices for the seller’s products and services are clearly stated on the invoice(s). Prices include all applicable taxes, services, and shipping fees.
2.3 Payment: Consumers must pay the total amount of the invoice(s) at the time of purchase unless special circumstances require a deposit at the time of purchase and then a final payment at the time of installation. Brighten Up accepts major credit cards, debit cards, cash, and checks. 


Timeframe and Scheduling
3.1 Force Majeure: Brighten Up strives to deliver the products within the estimated timeframe specified at the time of purchase. However, delays may occur due to unforeseen circumstances, and Brighten Up shall be not be held liable from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
3.2 Scheduling: Upon receipt of your order, Brighten Up will contact you to schedule the time of installation. Brighten Up will make reasonable efforts to accommodate your preferred installation date and time.

4.1 Access and Expectations: It is the consumer’s responsibility to ensure that the installation area is clear and accessible for Brighten Up’s installers. The installation of the window coverings will be done to the best of their abilities, following industry standards. However, slight variations may occur due to the nature of the products and the installation process.
4.2 Acceptance: By signing the completion form or accepting the installation, you acknowledge that the installation has been completed satisfactorily. Any issues or concerns regarding the installation should be reported to Brighten Up within 14 days of completion.


Cancellation and Refund
5.1 Cancellation: In accordance with FTC 16 CFR Part 429, the Cooling Off Rule states that consumers have the right to cancel a sales contract within three business days of the transaction.
5.2 Refunds: Refunds will be issued in the original form of payment within a reasonable time after an order has been canceled.
5.3 Non-Refundable Items: Custom made window coverings and or other custom made products are non-refundable. 


Limitation of Liability
The consumer acknowledges and agrees that Brighten Up shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the products or services provided.


No Guarantee
The consumer acknowledges and agrees that Brighten Up cannot guarantee the results or effectiveness of any products and services provided, rendered, or to be rendered. Rather, services shall be executed in accordance with industry standards and product warranty is provided by the manufacturer of said product(s).


Modification and Severability
Brighten Up reserves the right to modify and or update these Terms and Conditions at any time without prior notice. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


Acceptance of Terms
By engaging in any form of communication, purchase, and or use of the products and services provided by Brighten Up; the consumer acknowledges and agrees that they have read, understood, and agreed to abide by these Terms and Conditions.
